ImperialGuard VPN Terms of Service

Welcome to ImperialGuard VPN ("Service"). These Terms of Service ("Terms") govern your access to and use of our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Use of the Service

1.1 Eligibility: The Service is available to users of all ages. If you are under the age of 13, you may use the Service only with the involvement of a parent or guardian.

1.2 Account Registration: You may need to register for an account to access certain features of the Service. You agree to provide accurate and complete information when registering and to keep your account information up-to-date.

1.3 Device Limit: You are permitted to connect up to five (5) devices simultaneously to the Service under a single account. If more than five devices are connected at the same time, the Service reserves the right to temporarily block or limit access to additional connections.

1.4 Prohibited Activities: You agree not to engage in any of the following activities:

• Using the Service for any illegal or unauthorized purpose.
• Attempting to interfere with or disrupt the Service, servers, or networks.
• Using the Service to transmit any malicious code, viruses, or harmful software.
• Engaging in any activity that violates the rights of others, including but not limited to intellectual property rights and privacy rights.
• Using the Service to send spam, scan ports, scan for open proxies or open relays, send out opt-in, unsolicited e-mail, or any other form of mass email distribution, even if it eventually happens from another server.
• Making any attacks in any form on other computers or the network during your use of the Service.
• Engaging in computer hacking, virus propagation, fraudulent activities, network attacks, phishing, or any other actions deemed illegal or undesirable.

2. Privacy

2.1 Data Collection: Our Privacy Policy explains how we collect, use, and share your information. By using the Service, you agree to our data practices as outlined in our Privacy Policy.

2.2 Security: We take reasonable measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

3. Payment and Subscriptions

3.2 Billing: Subscription fees will be billed on a recurring basis as specified at the time of purchase. You authorize us to charge your payment method for the applicable subscription fees.

3.3 Cancellations and Refunds: You may cancel your subscription at any time. Refunds will be provided according to the refund policies of the platform through which you purchased the subscription (Google Play Store, Apple App Store, Microsoft Store).

4. Intellectual Property

4.1 Ownership: We own all rights, title, and interest in and to the Service, including all intellectual property rights. You may not use our trademarks, logos, or other proprietary information without our prior written consent.

4.2 User Content: You retain ownership of any content you submit through the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service.

5. Limitation of Liability

5.1 Disclaimer: The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy, reliability, or availability of the Service.

5.2 Limitation: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, or the like that may be transmitted to or through the Service; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

6. Service Availability and Quality

6.1 Service Coverage: The actual service coverage area, its speed, location, and quality may differ. Service strives to be available constantly, except for limited periods required for maintenance and fixing. Nevertheless, the service may not be accessible to the user under the influence of many factors beyond our control, such as emergencies, disturbances in the operation of third-party services, data transfer problems, equipment or network problems or deficiencies, interference, signal strength, etc., and therefore, the service can be interrupted, limited, or terminated.

6.2 Service Limitations: We are not responsible for the loss of data, messages, or pages that have not been delivered, have been canceled, or misdirected due to service outages or problems with the performance of the service, communication services, or network (for example, T1 or Internet). At our discretion, we can impose restrictions on the use of the service as a whole or its individual services, suspend the operation of the service, or block certain methods of using it to protect our users or service. The connection speed is approximate and does not characterize the speed with which the Service receives or sends data. The actual speed will be determined by the configuration, compression, network load, and other factors. Accuracy and timeliness of the received data are not guaranteed; delays and gaps are possible.

7. Indemnification

You agree to indemnify, defend, and hold harmless ImperialGuard VPN and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights. Users are responsible for the proper security parameters of their services and are also responsible for any damage caused by their carelessness or the creation of potentially dangerous situations, whether intentionally or unintentionally.

8. Changes to the Terms

We may modify these Terms at any time. We will provide notice of any changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. From time to time, we may publish new rules of service, which will become mandatory. It is the responsibility of the user to periodically visit this section and get acquainted with the innovations.

9. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
